Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs what content you may upload, ingest, or otherwise make available to the evercom.ai service (the "Service"), including any files, URLs, brochures, or text you provide for ingestion into the Service's knowledge base ("KB Content").
1. Public-data-only restriction
You warrant that all KB Content is, and will remain, content that is already publicly available and lawful for you to publish to the world. This includes but is not limited to:
- Course catalogues and brochures already published on your public website
- Public fee schedules, intake dates, scholarship pages
- Public visa, English-language, and admissions guidance
- Press releases and marketing collateral
- Publicly available faculty bios
You will NOT upload, ingest, or otherwise provide:
- Any personally identifiable information (PII) of students, applicants, employees, alumni, or any third party — including names, emails, phone numbers, ID/passport numbers, addresses, dates of birth, financial details, academic transcripts, or biometric data.
- Any student records subject to data-protection law in any jurisdiction, including (without limitation) Singapore PDPA, Australia Privacy Act, EU GDPR, UK GDPR, or US FERPA.
- Confidential, internal, or commercially sensitive material — including internal pricing, draft policies, board papers, financial statements not publicly filed, supplier contracts, employment terms, internal procedures, or anything marked "confidential", "internal use", or similar.
- Any content you are not the rightful owner or licensee of, or that infringes any third party's copyright, trademark, or other intellectual property rights.
- Any content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that promotes violence or discrimination.
- Any content subject to professional confidentiality (legal, medical, counselling notes, etc.).
- Any content that contains secrets — API keys, passwords, tokens, or credentials.
If you are unsure whether a document is "publicly available" or "non-confidential", do not upload it. The test is simple: if you would not publish this exact document on your institution's public website today, it does not belong in the KB.
2. Acceptable use of the Service
When using the Service, you will not:
- Use it to provide professional advice (legal, medical, immigration) that would require a licensed professional in the relevant jurisdiction;
- Make material claims to prospective students that you cannot back up (fee, accreditation, ranking, employment outcomes);
- Use the AI assistant to generate content that you then represent as human-written counselling, advice, or assessment;
- Attempt to extract, fine-tune, or otherwise replicate the underlying AI models;
- Probe, scan, or test the vulnerability of the Service, except via a responsible-disclosure channel agreed in advance with the Operator;
- Upload content with the intent to manipulate the AI's responses to third parties (prompt injection of the assistant against other tenants or end users);
- Resell, sublicense, or white-label the Service to a third party without a separate written agreement;
- Use the Service in any way that violates Singapore law or the law of any jurisdiction in which your end users are located.
3. End-user data
The Service collects limited personal data from end users (prospective students or agents who chat with the assistant) — primarily their email, name, role, and conversation transcript. This data is collected by the Operator under the Privacy Policy and shared with you only as a "qualified lead" record when an end user has expressed clear interest in your institution.
You agree to handle any end-user data shared with you in accordance with the Singapore Personal Data Protection Act 2012 (PDPA) and any other applicable data-protection law, and to use it solely for the purpose of responding to that end user's enquiry.
4. Indemnification
You will indemnify, defend, and hold harmless the Operator (evercom.ai) and its successors and assigns from and against any and all claims, losses, damages, liabilities, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or relating to:
(a) any KB Content you upload, ingest, or make available to the Service that breaches Section 1 of this AUP;
(b) any breach by you of any data-protection law arising from KB Content you provided;
(c) any third-party claim that KB Content you provided infringes that party's intellectual-property or privacy rights;
(d) any unlawful, fraudulent, or misleading representation you make to end users via the Service;
(e) any breach by you of Section 2 (Acceptable use).
This indemnity survives termination of your subscription.
5. Operator rights — content moderation
We reserve the right, but not the obligation, to:
- Inspect KB Content at any time, including via automated scanning, to verify compliance with this AUP;
- Remove, redact, or refuse to ingest any KB Content we reasonably believe breaches this AUP;
- Suspend or terminate your account immediately, without refund, on evidence of a material breach of Section 1 (Public-data-only restriction) or Section 2 (Acceptable use);
- Cooperate with law-enforcement and regulatory authorities to disclose KB Content where required by law.
We are not a "data intermediary" or "data processor" of confidential or personal data on your behalf. The Service is designed for public-information retrieval only, and is not certified or contracted for the storage of regulated personal or confidential data.
6. AI-generated content disclaimers
You acknowledge that the Service uses large language models, that LLM output can be inaccurate, incomplete, or hallucinated, and that you are responsible for any decisions made on the basis of LLM output. Where appropriate, you will disclose to end users that they are interacting with an AI assistant, not a human counsellor.
7. Reporting violations
If you become aware of any breach of this AUP — by an employee, agent, sub-processor, or any third party — notify the Operator within 72 hours at evercomai01@gmail.com.
8. Changes
We may update this AUP from time to time. Material changes will be notified to your administrator email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
9. Governing law
This AUP is governed by the laws of the Republic of Singapore. The Singapore International Arbitration Centre shall have exclusive jurisdiction over any dispute.
Acceptance. By creating a tenant on evercom.ai, by ticking the AUP acceptance checkbox during waitlist signup, or by uploading any KB Content, you confirm that you have read, understood, and agreed to this AUP, that you have the authority to bind your institution to it, and that the institution warrants the matters set out in Sections 1, 3, and 4.
